A preservação da sua originalidade e da sua integridade é essencial e vital à realização da justiça assente numa descoberta da verdade processual prática, material, judicial e válida, de modo que possamos afirmar que os direitos e liberdades fundamentais de todos os afetados pelo processo-crime sejam garantidos e, assim, restabelecida a paz jurídica e social. Moral reasoning typically informs environmental decision-making by measuring the possible outcomes of policies or actions in light of a preferred ethical theory. This method is subject to many problems. Environmental pragmatism tries to overcome them, but it suffers also from some pitfalls. This paper proposes a new method of environmental pragmatism that avoids the problems of both the traditional method of environmental moral reasoning and of the general versions of environmental pragmatism. We call it 'justificatory moral pluralism' - it develops (...) the intuition that normative ethical theories need not be mutually exclusive. This leaves room for important forms of pluralist environmental ethics that do not require a once-and-for-all prior commitment to an ethical theory when deciding about policies or courses of action related to the protection of the environment. Justificatory moral pluralism offers a viable solution to the recurrent conflicts between efficient environmental decisions and the need for moral reasoning. (shrink)

This paper adopts justificatory moral pluralism – a multilevel framework for justifying the choice by different agents of the most appropriate norms and values to guide their decisions and actions – to climate change. Its main objective is to investigate how ethics may effectively help achieve a better result in deciding how to mitigate, adapt, or compensate by enhancing the moral acceptability of the available policies or actions that are most likely to counter the effects of climate change. JMP presents (...) agents – individuals, nonstate, and state – with a thorough yet flexible process of matching policies and actions with ethical theories, raising the robustness of moral reasons for politically efficient and individually motivating courses of action against climate change. JMP triggers climate responsibility and sensibility in agents, engaging them in discussing and finding out individually and collectively the most acceptable paths for the decarbonisation transition that is fast approaching. As the world faces increasingly disparate challenges, science is being subjected to vehement demands from society calling for transparency, openness and public participation in science policy. This book provides a framework and a vision on how to conceive, discuss and evaluate the changes that occur in the relationship between science and society.

In this paper we criticize the existing contradictions in the context of bone marrow donor records in Spain. On the one hand there is the necessity to register as many patients as possible to maximize the opportunities to access a bone marrow transplant and on the other the always important economic issue of having to perform the relevant histocompatibility tests. In fact, these records are globally coordinated with each other to provide a wide range of potential donors and make better (...) use of existing resources. It should be noted that many patients who should have a transplant but who do not achieve a sufficient donor support must follow a medical treatment with high economic costs with tragic results for many of them. For example, those suffering from certain types of leukemia, when not finding that compatible donor, must follow chemotherapy-based treatments. There are also cord blood units banks which allow performing these transplants, also coordinated at the international level. Therefore, according to the principle of reciprocity, it is not justifiable that some countries are doing an important economic effort to have a large registration while others take advantage without making an equivalent effort according to their economic and population size. In the present work, an artificial neural network (ANN) will be developed to estimate the relative rotation and translation of the autonomous mobile robot (AMR). The ANN will work as an iterative closed point, which is commonly used with the singular value decomposition algorithm. This development will provide better resolution for a relative positioning technique that is essential for the AMR localization. The ANN requires a specific architecture, although in the current work a neural architecture search will be adapted to (...) select the best ANN for estimating the relative motion. At the end, these ANNs will be compared with conventional algorithms to check the good performance of adopting an intelligent method for relative positioning estimation. (shrink)

The Letter from Pero Vaz de Caminha to the King of Portugal, Manuel I, is a unique document because its account of first contact with a people unknown in Europe up to that time may be regarded as evidence of the anthropological impossibility of a neutral gaze. This is an asymmetric testimony, as we do not possess (for obvious reasons) the Amerindian counterpart of European discourse. Although the letter’s author is someone who fully assumes the objectivity claim, we must (...) not neglect the rhetorical framework of this assumption. Hence the need for textual analysis that seeks to somehow discern the boundaries between fiction and reality. It is not as an ethnographic document, indeed, that we should value the Letter. In fact, it is necessary to recognize that this is a beautiful piece of literature whose architectural weave owes everything to the classical mechanisms of Rhetoric. (shrink)

Environmental pragmatism has faced numerous criticisms for relativism and crude instrumentalism as well as for sidestepping the fundamental concerns of environmental ethics. Recently, Andre Santos Campos and Sofia Guedes Vaz have proposed a new ‘method’ of environmental pragmatism, justificatory moral pluralism, with the aim of overcoming these criticisms. It is argued that this new approach is plagued by the traditional concerns. Instead, the pitfalls of pragmatism can be avoided by adopting the central insight of the classical pragmatists that values (...) may be revised in light of experience in a process that resembles scientific inquiry. The resulting view may not be satisfying for those who expect pragmatism to live up to its periodic promise of immediate and concrete results. Nevertheless, pragmatism presents the environmental ethicist with a range of promising tasks. (shrink)

Up to now researchers have maintained that Nietzsche’s philosophy has no concept of social justice or have hardly noticed such a concept. On the contrary, this article argues that social justice plays an important role in Nietzsche’s political thinking. It shows that his conception of justice is modelled after Plato’s antique concept of political justice. The main thesis of the paper is that this conception is embodied in Nietzsche’s notion of a well-ordered state or society. An additional thesis concerns the (...) anthropological basis of what Nietzsche holds to be a just social order. This basis is constituted by his conviction that people are not only fundamentally unequal but also extremely different in worth and rank. (shrink)

The artificial intelligence models with machine learning that exhibit the best predictive accuracy, and therefore, the most powerful ones, are, paradoxically, those with the most opaque black-box architectures. At the same time, the unstoppable computerization of advanced industrial societies demands the use of these machines in a growing number of domains. The conjunction of both phenomena gives rise to a control problem on AI that in this paper we analyze by dividing the issue into two. First, we carry out an (...) epistemological examination of the AI’s opacity in light of the latest techniques to remedy it. Según una influyente línea interpretativa, la mejor polis de Aristóteles debe ser considerada una politeia. Esta corriente predomina aún hoy entre los eruditos alemanes. En tanto paladina de la “social democracia aristotélica”, Martha Nussbaum pertenece también a esta línea exegética. En oposición a tales interpretaciones, este ensayo defiende la tesis de que Aristóteles pertenece a la tradición de pensamiento político aristocrático. Esta tradición se remonta a Teognis, Heráclito y Platón y se inicia como una crítica dirigida tanto a la decadencia (...) de la virtud aristocrática cuanto al ascenso de valores democráticos e igualitarios. Este trabajo demuestra que Aristóteles concibe las diferentes formas de constitución como manifestaciones de distintas concepciones de la justicia distributiva. Aristóteles mantiene una clara preferencia por una concepción aristocrática de la justicia, y, por tanto, por la aristocracia. La constitución de la mejor polis que detalla en los libros VII y VIII de la Política debe entenderse como una “verdadera aristocracia” en la que los cargos políticos son distribuidos según el mérito entre los ciudadanos que sean los mejores desde el punto de vista moral e intelectual. This study compares the Internet (corporate web pages) and annual reports as media of social responsibility disclosure (SRD) and analyses what influences disclosure. It examines SRD on the Internet by Portuguese listed companies in 2004 and compares the Internet and 2003 annual reports as disclosure media. The results are interpreted through the lens of a multi-theoretical framework. According to the framework adopted, companies disclose social responsibility information to present a socially responsible image so that they can legitimise their behaviours to (...) their stakeholder groups and influence the external perception of reputation. Results suggest that a theoretical framework combining legitimacy theory and a resource-based perspective provides an explanatory basis for SRD by Portuguese listed companies. (shrink)

The emphasis of systems and synthetic biology on quantitative understanding of biological objects and their eventual re-design has raised the question of whether description and construction standards that are commonplace in electric and mechanical engineering are applicable to live systems. The tuning of genetic devices to deliver a given activity is generally context-dependent, thereby undermining the re-usability of parts, and predictability of function, necessary for manufacturing new biological objects. Tolerance and allowance are key aspects of standardization that need to be (...) brought to biological design. These should endow functional building blocks with a pre-specified level of confidence for bespoke biosystems engineering. O artigo procura apresenta os argumentos centrais das principais correntes interpretativas da Filosofia Política de Hegel na Alemanha, França e no Brasil de forma a avaliar e demonstrar o potencial de diagnose de tal esforço teórico; ao mesmo tempo, objetiva-se demonstrar desde estes autores como uma análise da obra de Filosofia Política de Hegel revela-se atual mediante a articulação de seu sistema como um todo.

There are important cases where properties not referred to by expressions from the languages of physics are enabled in certain times and circumstances to get causal control over some kinds of physical events. I will argue that in those cases we would have to transfer to those properties the causal sufficiency to bring about these events. This would offer a principle of causal inheritance in sharp contrast with the inheritance principle for the causal sufficiency of second order properties defended by (...) Jaegwon Kim in his recent discussion of the causal exclusion problem concerning mental properties. The two principles would be very different. Their domains of application would be distinct. Kim's principle would transfer causal sufficiency to the more "concrete" physical properties able to realize mental properties understood as second order properties. Our principle would transfer causal sufficiency to the more "general" properties able to cause the relevant physical effects in the times and circumstances in question. That way, it would be possible to give a quite simple answer to the problem of causal exclusion posed by Kim in relation to mental properties. Our approach also would have very important consequences in relation to ordinary macrophysical causation. (shrink)
